Supreme Court Deals a Blow to Obama's Effort to Prevent Deportations

Under Texas law a person cannot be condemned to death unless the prosecutor proves that he or she poses a future danger to society

Subsequently blocked from taking effect by a lower court, Obama took the executive action tactic in an effort to implement his plan, leading to the Texas-led litigation by 25 states.

The court's action affected about 4 million illegal immigrants estimated to be covered by Obama's plan, which would have deferred deportation for those who have been in the country since 2010, have not committed any serious crimes and have family ties to USA citizens or others lawfully in the country.

With oral arguments postponed for a day because of the Rosh Hashana Jewish holiday, the first Monday in October that marks the beginning of the new Supreme Court term became a day of rejection.

The high court remains one justice short following Antonin Scalia's February death.

"The State of Texas' position has been validated by the U.S. Supreme Court today as they denied the Obama administration's petition to rehear the immigration case", Paxton said in a prepared statement.

White House spokesman Josh Earnest expressed disappointment with the Supreme Court's action. "The states properly maintain that DAPA's grant of lawful presence and accompanying eligibility for benefits... is substantively contrary to law", the appeals court ruling stated.




In November 2014, Obama acted unilaterally, by executive action, and bypassed the Republican-led Congress to try to put his plan in place. "The Supreme Court is a separate branch of government that should move the nation forward as the Constitution intended not just wait and perpetuate the status quo of a dysfunctional Congress". Obama had aimed during his presidency to overhaul a US immigration system he calls broken and to help resolve the fate of the estimated 11 million people in the country illegally.

The Washington football team's request was something of a Hail Mary pass, as well.

The administration asked the high court to reconsider the case once a ninth justice is seated. These are the sorts of issues that have split the court along ideological lines before.

The most closely watched case set for oral arguments this week comes on Wednesday, when the court will consider an insider trading case that could make it more hard for prosecutors to bring such charges. Democratic nominee Hillary Clinton has said she will revive and expand the program; Republican nominee Donald Trump would end it for good.

The issue, though, will be covered in the court's current term. Ruth Bader Ginsburg is 83 and has said she will take it a year at a time.
