Homeower who killed showering intruder smiles in court appearance

A Washington state homeowner has been charged with murder for shooting dead an intruder who had broken in and was using his shower

A Washington state man was arrested on suspicion of second-degree murder after police said he shot and killed an intruder who was showering inside one of his residencies.

Prosecutor Michael Dorsey said Tuesday that he anticipates a decision on charging Bruce Fanning, 59, by Wednesday afternoon and offered further details on the events that led up to the death of Nate Rosa, 31, a paraeducator from Bothell who worked with disabled children.

Mason County Sheriff's posted on Twitter on Saturday saying: 'Lots of reactions to the arrest.

Fanning, who appeared at a bail hearing on Monday, told police that he found Rosa in the shower of his second home, which he uses for his online business selling knives, blowguns and paintball guns.

From there, Fanning told police leaving the building to retrieve a Smith and Wesson.45-caliber handgun. After noticing the front door kicked in and a missing window screen, the homeowner went inside and found the intruder in the shower. The arrest has already led to some internet controversy, with many discussing whether a second-degree murder charge was appropriate.

Police said Fanning fired four shots through the shower curtain, killing the intruder, according to the New York Times.

While not citing any specific evidence, local law enforcement said there is "more to the story". The man's arraignment was set for April 10. Fanning called authorities after the shooting.

While the state of Washington "has self-defense laws that protect property owners", Spurling said "use of deadly force must be necessary and reasonable".
