Apple iPhone slowing draws Justice Department, SEC scrutiny

Consumers so far have filed dozens of proposed class action lawsuits over Apple's latest iPhone software update which they allege caused unexpected shutdowns and hampered the performance of iPhone models of the SE 6 and 7 lines

Following similar probes in Italy and France, the US Department of Justice and the Securities and Exchange Commission are now looking into whether Apple violated securities laws through its actions. In a statement Wednesday, Apple confirmed receiving government inquiries, but did not specify from which agencies.

Apple apologised for the slowdown in a December 28 statement, citing a lack of clarity on its part: "We know that some of you feel Apple has let you down".

Yesterday, we told you that the SEC and DOJ were reportedly investigating Apple's decision to throttle CPU speed on certain models.

We sought to further improve the customer experience in December by announcing a significant discount on replacement batteries for certain iPhones. Other minor changes include new animoji (on iPhone X), iCloud support for Messages, and slight changes to Apple Music and Apple News, according to Apple Insider.

Just a few weeks after Apple disclosed it had been slowing down older iPhones, the company's stock surged to an all-time high, despite consumer outrage.

Meanwhile, the head of the commerce committee in the U.S. Senate had previously sent a letter to Apple demanding more information about the iPhone slowdown.




Apple admitted late previous year that it intentionally slowed down older models of its iPhones over time.

The iPhone maker would only confirm that the agencies are asking questions.

"The committee expects to receive Apple's response this week", said Hill, in an email. "Apple is a success that could only have happened in America, and we always felt a very big sense of responsibility to give back to our country and the people who have made our success possible", said Cook on Wednesday.

In a research note, reported on by Barron's, Tim Long predicted that Apple is likely to cut its guidance when it publishes its latest earnings Feb.1. In addition, users will be able to see if the power management feature is being used to prevent unexpected shutdowns, and turn it off if they so choose.

They claim the company tricked consumers into believing their phones were close to the end of their life cycle, forcing them to buy new phones or pay up to $80 for a replacement battery.
