FCC To Publish Net Neutrality Rule Reversal

The decision to rescind net neutrality, Obama-era regulations that ensure equal access to the internet, came in a 3-2 party line vote from the FCC in December where the panel's Republican members outvoted its Democrats.

Even though many people agreed with the basic premise of net neutrality, the FCC's rules became a lightning rod for controversy because they placed broadband providers under the same strict regulations that govern telephone networks.

At least five petitions have been filed at the U.S. Court of Appeals in Washington alone, with Mozilla-developer of the Firefox web browser and the video-sharing website Vimeo leading the way when the clerk's office opened for business.

The attorneys general who are suing argue that the FCC can not make "arbitrary and capricious" changes to existing policies.

Schneiderman said: 'Repealing net neutrality will allow internet service providers to put corporate profits over consumers by controlling what we see, do, and say online'.

Public Knowledge opposes Chairman Pai's deeply troubling break with nearly 20 years of bipartisan FCC support for the Open Internet, and even more radical abandonment of FCC broadband authority. That could take months. Net neutrality forced carriers and ISPs to treat all content the same.




Whether you're trying to buy a necklace on Etsy, stream a series on Netflix, or upload a photo to Facebook, your internet service provider has to load all of those websites equally quickly.

Broadband companies have said they do not intend to block, slow down or prioritize any web traffic as a result of the FCC's repeal, arguing that it's not in their interest to upset and potentially drive away subscribers. The order appeared in this morning's Federal Register; the Commission voted 3-2 along party lines to pass the "Restoring Internet Freedom" order over strenuous objections from consumer groups and the public, and allegations that numerous pro-order comments received by the FCC were faked and/or from stolen identities and possibly the result of Russian interference.

The reinstatement would still then be subject to a likely veto by President Trump.

Congress might have the best shot as net neutrality remains rather popular among voters.

The lawsuit isn't the only action states are taking to preserve net neutrality.

Separately, governors in five states - Montana, New Jersey, New York, Hawaii, and Vermont - have passed Executive Orders requiring any ISP with a state contract to adhere to net neutrality.
