Cosby's new legal team tried to get the re-trial judge removed but were unsuccessful

The judge in Bill Cosby's sexual assault retrial gave his legal defence a huge lift Tuesday with two key rulings that could help bolster the 80-year-old comedian's efforts to paint his accuser as a money-grubbing liar.

Cosby stumbled a bit getting out of an SUV on Thursday and then put a hand up to say he was OK before walking into the suburban Philadelphia courthouse where lawyers will work to pick six alternate jurors.

Two of the 12 jurors - a man and a woman - are black; the rest are white.

Cosby's lawyers had accused prosecutors of racial discrimination Wednesday for excluding a black woman from the panel.

Cosby's lawyers had appeared ready to strike at the first instance of prosecutors blocking a black juror, producing a legal brief that argued the move violated a 32-year-old Supreme Court ruling that prohibits prosecutions from excluding prospective jurors due to their race.

Steve O'Neill, the presiding judge in the Cosby trial, openly doubted that the exclusion of the black juror was based on discrimination, but he nonetheless chose to stop jury selection in order review the defense motion.

The comedian was charged with three charges of aggravated indecent assault for allegedly drugging and sexually assaulting Andrea Constand at his home outside Philadelphia in January 2004.

O'Neill called the jury-selection process "long and arduous".

On Tuesday, Cosby lawyer Kathleen Bliss sprung a Batson challenge on the judge after prosecutors used one of their seven peremptory challenges to strike a white male. He also ruled that the jury can hear the amount of the settlement that Cosby reached with his accuser. O'Neill did not explain his change of heart but issued one caveat, saying he could revisit her testimony after Constand takes the stand. The young man said he had no knowledge of Cosby's case.




District Attorney Kevin Steele responded there was "absolutely no legitimacy" to the defense's challenge, adding that prosecutors had no problem seating the two other black people who'd appeared for individual questioning. But prosecutors and Cosby's lawyers both found him acceptable.

All but one of the people in the initial group of potential jurors said they were aware of the #MeToo movement or the allegations it spurred against powerful entertainment figures.

The camera shows the judge, prosecutors and defence lawyers, but not potential jurors who are being questioned as a group.

Bliss also accused one member of the prosecution team - whom she did not name - of making "discriminatory and repulsive" comments, which she did not detail or describe in open court.

The young man picked as a retrial juror Monday said he did not know anything about Cosby's case. Montgomery County President Judge Thomas DelRicci agreed to move the camera to the back of the courtroom so the media could see the potential jurors.

O'Neill ruled Tuesday that Marguerite Jackson, a former Temple University staffer who claimed Constand told her she could lie about a sex assault story to get money, can testify at the retrial, giving Cosby's defense team a boost.

Constand's lawyer has said Jackson is not telling the truth.

The Associated Press doesn't typically identify people who say they're victims of sexual assault unless they grant permission, which Constand has done.
