Lyft Says It Won't Force Misconduct Cases Into Arbitration Anymore

Uber ends policy of forced arbitration for individual sexual assault claims

The ride-hailing companies announced Tuesday they would eliminate the requirement of arbitration clauses for any employee, driver or rider who claims they have experienced sexual harassment or assault.

MWW PR chair reputation management and chief strategy officer Careen Winters says that Uber's new direction should remind communicators that doing the right thing is always a good move.

Uber competitor Lyft says it will no longer force victims of sexual assault into arbitration.

Previously, upon signing up for Uber or Lyft services, users had to agree to resolve claims on an individual basis through arbitration.

Uber is giving its passengers and drivers a new way to report sexual misconduct. "However, the company decided in these personal and hard set of claims the company wanted to give survivors the choice to seek redress in the venue of their choice, whether that's mediation, arbitration, or open court".

As part of its investigation, CNN also contacted more than 20 police departments to obtain data on complaints that involved Uber and Lyft drivers and sexual assault. "Whether to find closure, seek treatment, or become advocates for change themselves, survivors will be in control of whether to share their stories". "Data transparency is only meaningful if we describe and categorize sexual assault incidents in the same way".

A CNN investigation revealed at least 103 Uber drivers in the USA were accused of sexually assaulting or abusing passengers in the past four years. (Were it not for its own sexual harassment issues and pressure from people like Fowler, whether Uber would have done away with the clause is anyone's guess.) But if Uber continues to reform, even if only on a surface level, it could effectively kick off an optics arms race, compelling other Silicon Valley companies to bow to social pressure by following suit. "This policy extends to passengers, drivers and Lyft employees", said Lyft spokesperson Alexandra LaManna in a statement on Tuesday. In order to "do better" (or at least give that impression), Uber is now changing policies it should never have had in the first place. Yay? He joined Uber as the company was going under a public and top of the food chain transformation.

In a statement to ABC News, West admitted that while the updated effort "won't apply to class-action suits", it "impacts the vast majority of assault claims we see on our platform". "This is the beginning of a longer process needed to meaningfully improve safety". (I deleted the app a year ago, after a driver found my phone number-through his trip history, I assumed-and repeatedly texted and called me.) Last month, Uber implemented a host of long-delayed safety features, such as an emergency-call button that connects a rider to a 911 operator and features real-time location data from the moving auto. Khosrowshahi replied that he would "take a look at your suggestion".
